The developer of Tamarac Village, JKM Tamarac Village, LLC, has filed a lawsuit against the city of Tamarac, alleging that the city failed to pay additional costs for public improvements constructed at the Tamarac Village project.
The complaint is for damages and injunctive relief. JKM is seeking payment from Tamarac for $572,882.07 for pubic improvements, for engineering fees of $12,315, and legal costs of $17,931.51, for a total of $603,128.58 for Tamarac Village, according to the lawsuit filed at the Broward County Courthouse on December 22.
JKM alleges that Tamarac agreed it would be responsible for any increased costs associated with the addition, deletion, or modification of the site plan and cost estimates JKM completed.
JKM complains that the city failed to pay for increased costs associated with improvements to the park property. The city failed to pay for the removal and reinstallation of royal palm trees, and JKM paid a landscaper $127,707 for the work. The city failed to pay for the replacement of pavers at the project, and JKM paid $84,750 for the job and $84,750 for maintenance of traffic, for a total of $94,750. The city has failed to pay JKM for these increased costs, according to the lawsuit.
The city has also failed to close out permits and release improvement and performance warranty bonds, according to the lawsuit.
