A Tamarac man faces an attempted murder charge after deputies said a rent dispute shooting left a victim intubated and in critical condition.
According to a Broward County Sheriff’s Office arrest report, Xavier Aiden Mojica, 23, was arrested following the May 3 shooting at a home located near the 7600 block of Northwest 74th Terrace.
Deputies said they responded to 911 calls from the home and found the victim suffering from a gunshot wound to the torso. BSO Fire Rescue provided medical treatment at the scene before transporting the victim to a hospital.
According to the report, medical staff later advised that the victim was intubated and listed in critical condition.
Investigators said the shooting stemmed from a dispute at the residence involving rent issues and an impending eviction. According to witness statements summarized in the report, several people had gathered at the home when an argument between Mojica and others escalated.
One witness told detectives that during the confrontation, another person had a knife and a key in his hand before pushing Mojica to the ground. The witness said Mojica then pulled out a gun and fired, striking the victim. After the shooting, deputies said Mojica fled southbound on Northwest 74th Terrace before later returning to the scene with the firearm.
According to the report, a second struggle then broke out over the gun. A witness told deputies the firearm ended up on the ground before being picked up and placed inside the residence.
Detectives later interviewed Mojica, and he told investigators he had been involved in an altercation in the patio area and said someone had earlier retrieved a kitchen knife. However, deputies said Mojica also stated the knife had been thrown back inside the residence before the shooting occurred.
Investigators wrote that Mojica admitted neither the victim nor another person near him had anything in their hands when he fired. BSO Fire Rescue also did not locate any weapons on the victim while treating him, according to the report.
Deputies said Mojica claimed he fired because he was afraid, but investigators wrote that his self-defense claim was not supported by the facts known at the time. According to the report, Mojica said he did not know whether the others were approaching to help him up or assault him after he fell.
The report concludes, stating that the victim pushing Mojica to the ground did not justify Mojica’s use of deadly force.
Based on the investigation, deputies said probable cause existed to charge Mojica with attempted murder. He was arrested and transported to the Broward County Main Jail.
